Abstract

The advantages of asset-backed securities are many, namely that investors can invest in quality assets, there is low default due to the division of receivables into many debtors, it is suitable for investors with faster principal return needs, and the high-profit rating of asset-backed securities can increase the overall investment portfolio. This research examines the analysis of asset-backed securities (ABS) in the study of Maqashid Shariah. The method used in writing this research is library research, with data collection directed directly to the search for data and information through books, literature, or library materials, including written documents, photographs, pictures, and electronic documents. The results of this research indicate that ABS is a financial instrument in the form of a collective investment contract unit that contains a portfolio of financial assets. The practice of asset securitization in ABS transactions has several advantages and risks. ABS has participated in various state projects and is generally very useful. To unravel liquidity problems on the originator's side and at the same time present alternative instruments with low risk for investors, it can be seen that it has included Maqashid Ash-Shari'ah, namely Hifdz Al-Maal which is included in the Dharuriyyat category from the originator's side as a solution to asset liquidity and Hajiyyat from the investor's side.

Abstract

Issues of violence are often juxtaposed with religion; every religion seems to be inseparable from the dogma of violence. Ironically, the message of peace and non-violence in the holy books of religions tends to be ignored. This article does not aim to find differences but rather similarities as a reflection of comparative studies between religions to open new perspectives. This research is qualitative research with a comparative descriptive analysis method. Two fundamental questions in this research are how the scriptures of the world's largest religions (Judaism, Christianity, Islam, Hinduism, and Buddhism) speak about non-violence and worldviews related to inter-religious violence. The term violence in the scriptures of the heavenly religions (Judaism, Christianity, and Islam) is still present today, either in the form of God's encouragement and command or as a consequence of an event, while in the earthly religions (Hinduism and Buddhism) the term violence is not found. Despite this, radical and fundamentalist groups who claim their actions as legal defense according to religion still occur frequently; if this is true, acts of religious terror violence should not occur in earthly religions because there is no affirmation in their holy books. Therefore, this research agrees with Mark Juergensmeyer's opinion that the study of religious terror must be raised together with the context in the form of historical situations, social locations, and worldviews related to violence because the violence contained in the holy book has its own time and event limitations.

Abstract

The emergence of Islamic orthodoxy and philosophy created contestation between the two. The figure who directly confronted Muslim philosophers was Al-Ghazali. He criticized Muslim critics on several issues. Next, Ibnu Rushd appeared to answer Al-Ghazali criticism. Contestation between the two occurred in the 11th-12th century AD, but the discourse of both ideas is still widely studied today. This article analyzes the contestation of Islamic orthodoxy and philosophy in the 11th-12th centuries AD. The method used is qualitative with the type of library research. The research source comes from the works of Al-Ghazali and Ibn Rushd and was analyzed using descriptive analysis. This research shows that the contestation between orthodoxy and philosophy has been going on for a long time. As an orthodox person, Al-Ghazali tried to criticize philosophers through several issues related to philosophers' views, such as the eternity of nature, the knowledge of God, and physical resurrection, which Ibnu Rushd then answered as a philosopher. The contest between the two has experienced a long history of debate and debate. It is also necessary to understand these differences because both are an integral part of Islamic intellectual history. Both approaches have advantages and disadvantages, giving rise to dialogue and discussions relevant to the contemporary Islamic era. It should also be noted that both have a role in completing the understanding of Islam.

Abstract

Around the 18th century, Muslims experienced a period of intellectual stagnation as a result of ijtihad, which appeared to have been tightly shut. Furthermore, heretical and khurafat traditions are becoming increasingly common. Consequently, Muslims drifted further away from the Quran's teachings and the Prophet's Sunnah. These kinds of circumstances motivated Muhammad ibn ‘Abd al-Wahhab to respond by attempting to restore the original spirit of Islamic revivalism (Tajdid) by going back to the pure teachings of Tawhid, as his predecessors, Ahmad bin Hanbal and Ibn Taymiyyah, had done previously. This paper aims to examine the characteristics of Muhammad ibn ‘Abd al-Wahhab’s purification of the Tauhid and his role in the establishment of the Kingdom of Saudi Arabia, which was regarded as one of the most successful ideologies institutionalizing the puritanical Islamic revival has ever seen in the history of contemporary Islamic politics. This work applies qualitative methodology with a historical approach, carried out by collecting data from Ibn ‘Abd al-Wahhab’s book as a primary source and other related books, journals, and articles as secondary sources. The research found that Ibn ‘Abd al-Wahhab's tajdid began as a religious movement and rose to prominence after collaborating with Muhammad ibn Saud's political effort. After the foundation of the Kingdom of Saudi Arabia a century and a half later, this idea was successfully established as a state-owned ideology. The birth of the kingdom was inextricably connected to the growth of Nationalism in the Islamic world as a result of European colonialism.

Abstract

Education and teaching in Islamic history have started since the Prophet received the first revelation in Mecca. When the Prophet migrated to Medina, he founded a mosque as the center of Muslim activity. Thus, this study aims to describe the Flashback of the Mosque in the Trajectory of History. The method used is a literature study with a historical-theological approach, which was then analyzed descriptively and concluded. The results of the study show that the Flashback of the Mosque in the Trajectory of History at the time of the Prophet was very simple but meaningful because it was used as a center for the spiritual development of faith, economy, education, politics, cultural arrangement and all forms of human social order. Then, during the time of the companions, the Mosque underwent physical development, starting from the expansion of buildings to the construction of new mosques in areas successfully conquered by the Muslims, even though the roles and functions were still the same as those of the Prophet Muhammad. Then, during the Umayyad and Abasiyyah periods, mosques experienced rapid progress in infrastructure and art, where towering towers and large mosque domes appeared. Still, their role and function decreased because they were only used as religious centers.

Abstract

The contemporary reality of society often neglects the significance of family life while prioritizing economic pursuits, religious endeavors, and missionary activities. As evident in the narrations, it disregard for Islamic values raises the relevance of recognizing the family's precedence over the imperative to engage in Islamic causes, as emphasized in the Hadith narrated by Mālik ibn al-Huwayrith. This study aims to extract the essence of the Hadith to address contemporary challenges in da'wah and religious deepening potential catalysts for family abandonment. This research method uses a qualitative approach with a hermeneutical model in data analysis; the research reveals that Mālik's allegiance, even posthumously, signifies his inclination to remain in the City of Hijrah for the advancement of Islam, a disposition the Prophet "rejected" by instructing him to return to his family. Despite Mālik's assumption about the Prophet understanding their yearning for their families, this sentiment was never explicitly articulated. Consequently, the Hadith underscores the virtue of being with one's family, emphasizing that journeys for religious enrichment or other purposes do not absolve the obligation to be with the family. Furthermore, the Hadith conveys that whatever is gained during the trip, whether knowledge or material possessions, rightfully belongs to the family left behind.

Abstract

The neutrality of ASN in practical political activities is a problem that has not been resolved by the government or the election organizers themselves. Thus far, 2024 has been the biggest political year in the history of Indonesian democracy because it elects the president and his deputy and legislative members from the center to the regions. In the same year, regional head elections were held simultaneously throughout Indonesia. Thus, appropriate efforts and steps are needed to overcome the problem of ASN neutrality. This article aims to find the concept of regulating ASN neutrality in the 2024 simultaneous elections and future elections. Normative legal research was chosen as an analytical tool to answer the legal issues that are the focus of the study in this article. The results of the research show that efforts to prevent ASN neutrality in elections and Regional Head Elections can be carried out by strengthening them institutionally to maximize their duties and functions such as KASN, KPU_Bawaslu to DKPP, both of the ASN elements themselves by building political awareness through political and legal education. The Regional Government, BKN, BKD, or each government agency can initiate it. In conclusion, the joint commitment of all parties, including the KPU-Bawaslu DKPP to ASN and respective government agencies, is the main key in closing the space for ASN involvement in practical political activities, especially in the simultaneous and regional elections in 2024.
